Terms of Service

Effective Date: January 15, 2026

Applies to: ehumphress.com and whiteboston.com (the "Site"), operated by WhiteBoston LLC ("WhiteBoston," "we," "us," or "our").

1. Services

WhiteBoston LLC provides three primary service offerings:

Operations Reset Consulting: Operational consulting, workflow design, systems implementation, and business structure services for service-based founders. Specific deliverables and pricing are described on our Site or in any written service agreement between you and us.

Social Media Services: Social media management services, including content creation, video production, and social media account management on a monthly retainer basis.

Website Design Services: Custom website design and development services on a project basis. Specific scope, deliverables, pricing, and timeline are outlined in individual project agreements or contracts.

By booking services, purchasing programs, or using our Site, you agree to these Terms. If you do not agree, do not use the Site or Services.

2. Account, Booking & Communications

Account setup: You must provide accurate contact and business information when booking services, subscribing to our newsletter, or engaging with our Site.

Newsletter: By opting into our newsletter via Beehiiv, you consent to receive email communications including operational tips, content updates, and service announcements. You may unsubscribe at any time using the link in any email.

Bookings: Services requiring consultation or onboarding (such as clarity calls or program kickoffs) are scheduled through Google Calendar. Meeting confirmations and reminders are sent automatically by Google Meet.

Intake information: You may be asked to provide information about your business, goals, current tools, or operational challenges to complete your intake. You are responsible for the accuracy of this information.

Rescheduling: You may reschedule meetings using your original calendar link. We reserve the right to charge or deprioritize repeat no-shows for paid or limited services.

3. Operations Reset: Deliverables & Limitations

Deliverables are limited to what is specified in your selected program, service agreement, or scope of work. We provide operational frameworks, workflow design, process documentation, system implementation support, and strategic guidance intended to improve your business operations and reduce operational bottlenecks.

While our services are designed to create clarity, efficiency, and time savings, we do not guarantee specific financial results, revenue growth, or performance outcomes. Results depend on your implementation, business context, and commitment to adopting the systems provided.

4. Social Media Services: Scope & Client Responsibilities

Services provided: We offer ongoing social media management services on a monthly retainer basis, including content creation, video production, and account management. Specific deliverables and pricing are outlined in your service agreement or contract.

Client access & materials: You agree to provide us with access to your social media accounts, brand assets, and any other materials necessary to deliver services. You are responsible for maintaining the security of your account credentials.

Content approval: Services are delivered without a formal approval process. Content is created and posted directly to your accounts based on our professional judgment and your stated preferences.

Content ownership & storage: Once content is posted to your social media accounts, you own that content as part of your account. We do not retain raw footage, source files, or backups. The delivery of services is complete when content is posted to your accounts.

Portfolio & case studies: We do not use client work in our portfolio, case studies, or promotional materials without explicit written permission.

5. Website Design Services: Scope & Client Responsibilities

Services provided: We offer custom website design and development services on a project basis. Services are platform-agnostic and adapt to your existing or preferred website platform. Specific scope, deliverables, timeline, revisions, and pricing are outlined in individual project agreements or contracts.

Hosting & domain: You are responsible for purchasing and maintaining your own domain registration and website hosting. We do not provide hosting services. We can provide consultation on hosting and maintenance options.

Content & materials: You may provide content (copy, images, branding) or request that we create it as part of the project scope. Content creation services, if requested, will be specified in your project agreement.

Ownership & access: Upon full payment, you own the completed website outright. We do not retain intellectual property rights to custom code or design elements created specifically for your project. You receive full access and control of your website upon project completion.

Post-delivery changes: Revisions included in your project are specified in your project agreement. Additional changes or updates requested after project delivery are subject to separate fees.

Maintenance & support: We provide build-only services. Once delivered, you are responsible for maintaining and updating your website. We are not responsible for issues arising after delivery unless they are directly related to design defects present at the time of delivery.

Training: Training on how to update and maintain your website can be provided upon request and may be included in your project agreement.

6. Fees & Payment

Fees: Pricing for programs and services is listed on our Site, in your order form, or in a written service agreement.

Payment terms: All services are billed as one-time payments unless otherwise specified in your service agreement. Recurring monthly services (such as social media management) are billed at the beginning of each monthly cycle.

Payment processing: Payments are processed via QuickBooks invoicing and may be paid through Stripe or other payment methods as specified on your invoice.

Refunds: Program fees are subject to the specific refund or guarantee terms outlined in your service agreement or offer document. In the absence of a specific guarantee, fees are non-refundable once services have begun or been delivered.

Cancellations: For ongoing monthly services, you may cancel at any time by providing 30 days' written notice via email to support@whiteboston.com. You remain responsible for payment through the end of the 30-day notice period.

7. Your Responsibilities

You agree to:

  • Provide accurate and up-to-date contact and payment information
  • Supply any necessary information, access credentials, brand materials, or context needed for us to deliver services effectively
  • Use the Services only for lawful business purposes
  • Not share proprietary frameworks, templates, or materials provided as part of the Services without permission
  • Maintain the security of any account credentials or access you provide to us

8. Intellectual Property

WhiteBoston IP: All content, frameworks, workflows, templates, documentation, and proprietary methodologies (including The Operations Reset Framework) provided by WhiteBoston LLC remain our intellectual property. We grant you a limited, non-exclusive, non-transferable license to use them internally for your business while your engagement with us is active.

Your content: You retain ownership of any content, data, or business information you provide to us. By providing such content, you grant us permission to use it solely to deliver Services to you.

Social media content: Content created and posted to your social media accounts as part of our social media services becomes your property once posted. We do not retain ownership or copies of final deliverables.

Website design: Custom websites, code, and design elements created specifically for your project become your property upon full payment. We do not retain intellectual property rights to project-specific work.

9. Confidentiality

We treat any non-public information you provide (e.g., business data, operational details, system credentials, account access) as confidential. We will not disclose or use such information except to deliver the Services or as required by law. You agree to maintain confidentiality of our proprietary materials, frameworks, and methodologies.

10. Data & Privacy

Your personal information and business data are governed by our Privacy Policy. All information you provide or upload remains your property. We do not use or sell your business data for marketing or analytics purposes.

Email addresses collected via website forms or lead magnets are managed through Beehiiv, our email newsletter platform. Meeting scheduling and communications are handled via Google Calendar and Google Meet. All data is processed on secure, U.S.-based servers.

11. Prohibited Uses

You may not use our Site or Services to:

  • Violate laws or infringe others' rights
  • Redistribute, resell, or repurpose our proprietary frameworks, templates, or materials
  • Attempt to reverse engineer or interfere with our platform or systems
  • Misrepresent your relationship with WhiteBoston LLC
  • Share account access or credentials provided to you with unauthorized third parties

12. Disclaimer of Warranties & Limitation of Liability

Our Site and Services are provided "as is."

We do not warrant uninterrupted or error-free operation. To the maximum extent permitted by law, we are not liable for any indirect, incidental, or consequential damages, including lost revenue or profits. Our total liability for any claim will not exceed the amount you paid us in the six months preceding the claim, or $100 if you did not pay anything.

13. Indemnification

You agree to defend, indemnify, and hold harmless WhiteBoston LLC, its affiliates, and employees from any claims, damages, or losses arising from your use of our Services, data, or violation of these Terms.

14. Termination

We may suspend or terminate your access for violation of these Terms, misuse, or nonpayment. You may cancel your services at any time in accordance with the cancellation terms outlined in Section 6. Termination does not affect any outstanding fees owed for prior use or completed services.

15. Governing Law

These Terms are governed by the laws of the State of Texas, USA, without regard to conflict-of-law principles. You agree to submit to the exclusive jurisdiction of state and federal courts in Texas.

16. Changes to Terms

We may revise these Terms periodically. Material changes will be posted with an updated effective date. Your continued use of the Site or Services after updates constitutes acceptance of the new Terms.
